Notice of Public Meeting of a Zoning Bylaw Amendment MV2024-02
NOTICE OF PUBLIC MEETING
CONCERNING A PROPOSED MINOR VARIANCE APPLICATION
TAKE NOTICE that the Municipality of Marmora and Lake Council will hold a Public Meeting on November 19, 2024, at 5:30 p.m. via Hybrid Meeting to consider a proposed minor variance application under Section 45 of the Planning Act for the application numbered as MV2024-02. The meeting will be conducted IN PERSON in Council Chambers at 12 Bursthall Street, Marmora, ON, and VIRTUALLY and be streamed via YouTube, which is linked via www.marmoraandlake.ca.
Location of Subject Lands: The property municipally addressed as 67 Silver Maple Lane and legally described as Part of Lot 11, Concession 4, Part 1 on Registered Plan 21R-8984, Municipality of Marmora and Lake, Hastings County has been received. A key map showing the location of the subject property is attached to this Notice.
The purpose and effect of the application is to construct an accessory building that will be located 14.75 metres from the highwater mark and will be located in front of the existing primary structure.
The applicant has requested relief from the following policy:
5.9.2: Notwithstanding anything in this By-law, no building, structure, or septic tank installation including the weeping tile field (‘no development’) shall be located:
i. within 30 metres (98.4 ft.) (15 metres (49.2 ft.) for a septic system) of the highwater mark of a waterbody or permanent watercourse, notwithstanding that such body of water or watercourse is not shown on any schedule forming part of this Bylaw
The proposed accessory building will be 14.75 metres (48.4 feet) from the high watermark
5.25.2: Any accessory building which is not part of the main building shall be erected to the rear of the projected front or exterior side wall of the main building. Where accessory buildings are located behind the main buildings, they shall be located in accordance with the provisions of the particular zone.
The proposed accessory building will be located in front of the principal building
Additional information relating to the application for the proposed minor variance is available for inspection by any member of the public during regular business hours at the municipal office, 12 Bursthall Street, Marmora, ON, K0K 2M0.
If you wish to be notified of the decision of the Municipality of Marmora and Lake on the proposed minor variance, you must make a written request to Municipality of Marmora and Lake at 12 Bursthall Street, P.O. Box 459, Marmora, ON, K0K 2M0.
ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed minor variance. If attending virtually please contact Kristen McConnell, Acting Clerk, by Friday, November 15th, 2024.
If a specified person or public body would otherwise have an ability to appeal the decision of the Council of the Municipality of Marmora and Lake to the Ontario Land Tribunal (OLT) but the specified person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Marmora and Lake before the bylaw is passed, the person or public body is not entitled to appeal the decision.
If a specified person or public body does not make oral or written submissions at a public meeting or make written submissions to the Municipality of Marmora and Lake before the bylaw is passed, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in
the opinion of the Tribunal, there are reasonable grounds to do so.
