NOTICE OF DECISION ON A ZONING BYLAW 2020-45P BY THE MUNICIPALITY OF MARMORA AND LAKE

TAKE NOTICE that the Council of the Municipality of Marmora and Lake passed BYLAW 2020-45P on the 5th day of January 2021 under Section 34 of the Planning Act, 1990, as amended.

AND TAKE NOTICE, under the Planning Act Section S.34 (19) any person or public body may, not later than 20 days after the day that the giving of written notice as required by subsection (18) is completed, appeal to the Local Planning Appeal Tribunal in respect of the bylaw by filing with the Municipal Clerk the Appellant Form (A1) setting out the objection to the bylaw, and the reasons in support of the objection accompanied by the fee prescribed $1,100.00 payable to the Minister of Finance. Only individuals, corporations and public bodies may appeal a zoning bylaw to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.

THE PURPOSE AND EFFECT of the proposed zoning by-law amendment was to rezone the subject lands located on Concession 9, Part Lots 26 & 27, Part 1 on Reference Plan 21R-22510 in the Township of Marmora and Lake from the Marginal Agricultural (MA) Zone to the Limited Service Residential (LSR) Zone.

Public Consultation on the zoning amendment bylaw for this decision was provided from December 9, 2020, to January 4th, 2021. The Municipality received a total of 1 comment from the public (applicant) in favour of the application. As a result of public consultation on the zoning amendment bylaw, the effect of the Public Consultation was that Council considered the input, and the public response to the application influenced Council’s decision.

Council of the Municipality of Marmora and Lake, on January 5th, 2021, approved the rezoning application.
