Notice of Public Meeting of a Zoning Bylaw Amendment MV2024-01
NOTICE OF PUBLIC MEETING
CONCERNING A PROPOSED ZONING BYLAW AMENDMENT
TAKE NOTICE that the Municipality of Marmora and Lake Council will hold a Public Meeting on October 15, 2024, at 5:30 p.m. via Hybrid Meeting to consider a proposed zoning bylaw amendment 45 of the Planning Act for the application numbered as MV2024-01. The meeting will be conducted IN PERSON in Council Chambers at 12 Bursthall Street, Marmora, ON, and VIRTUALLY and be streamed via YouTube, which is linked via www.marmoraandlake.ca.
Location of Subject Lands: The property municipally addressed as 113 Peepy Horn Road and legally described as Part Lot 2, Concession 12, Municipality of Marmora and Lake, Hastings County has been received. A key map showing the location of the subject property is attached to this Notice.
The purpose and effect of the application is to rebuild an existing cottage, which currently does not comply with the requirements of the Waterfront Residential (WR) Zone. The layout of the proposed cottage will either improve (the front yard setback will be 12.37 metres whereas 7.2 metres exists) or meet (the smallest interior yard setback will be 4.26 metres whereas 3.0 metres is required) minimum standards of the Bylaw. However, the rear yard setback of the proposed cottage will be decreased on the eastern corner to 26.37 metres.
The applicant has requested relief from the following policy:
· 10.3.a) v) For the Principal Building: Rear Yard (Minimum) 30 metres (98.4 ft.) (i.e. setback from highwater mark)
o The proposed principal dwelling is proposed to be 26.37 metres from the highwater mark
Additional information relating to the application for the proposed minor variance is available for inspection by any member of the public during regular business hours at the municipal office, 12 Bursthall Street, Marmora, ON, K0K 2M0.
If you wish to be notified of the decision of the Municipality of Marmora and Lake on the proposed minor variance, you must make a written request to Municipality of Marmora and Lake at 12 Bursthall Street, P.O. Box 459, Marmora, ON, K0K 2M0.
ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed minor variance. If attending virtually please contact Kristen McConnell, Deputy Clerk, by Friday, October 11, 2024.
If a specified person or public body would otherwise have an ability to appeal the decision of the Council of the Municipality of Marmora and Lake to the Ontario Land Tribunal (OLT) but the specified person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Marmora and Lake before the bylaw is passed, the person or public body is not entitled to appeal the decision.
If a specified person or public body does not make oral or written submissions at a public meeting or make written submissions to the Municipality of Marmora and Lake before the bylaw is passed, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
