Notice of Public Meeting of a Zoning Bylaw Amendmend 2023-40P

NOTICE OF PUBLIC MEETING
CONCERNING A PROPOSED ZONING BYLAW AMENDMENT

TAKE NOTICE that the Municipality of Marmora and Lake Council will hold a Public Meeting on August 1, 2023, at 5:30 p.m. via Hybrid Meeting to consider a proposed zoning bylaw amendment under Section 34 of the Planning Act for the application numbered as 2023-40P. The meeting will be conducted IN PERSON in Council Chambers at 12 Bursthall Street, Marmora, ON, and VIRTUALLY and be streamed via YouTube, which is linked via www.marmoraandlake.ca.

Location of Subject Lands: An application to amend the Zone classification for property located on Deloro Road, Marmora, ON legally described as Concession 10, Part Lot 16, Part 5 on Registered Plan 21R-9655; Municipality of Marmora and Lake, Hastings County has been received. A key map showing the location of the subject property is attached to this Notice.

The purpose and effect of the proposed zoning bylaw amendment is: To rezone the subject lands from Waterfront Residential (WR) Zone to Waterfront Residential Exception No. X (WR-X) Zone to permit the minimum required front yard setback for a dwelling to be 19.2 m (63 ft), the minimum required front yard setback to a deck/porch to be 17 m (55.8 ft), and minimum setback to a Mineral Extractive (MX) Zone shall be 20 m (65.6 feet). The affect of the amendment will be permitting the development of a dwelling on the subject lands.

Additional information and material relating to the application for the proposed zoning by-law amendments is available for inspection by any member of the public during regular business hours at the municipal office, 12 Bursthall Street, Marmora, ON, K0K 2M0.

 If you wish to be notified of the decision of the Township of Marmora and Lake on the proposed zoning by-law amendment, you must make a written request to Township of Marmora and Lake at 12 Bursthall Street, P.O. Box 459, Marmora, ON, K0K 2M0.

 ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed zoning bylaw amendment. If attending virtually please contact Kristen McConnell, Deputy Clerk by Friday, July 28th, 2023.

 If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of Marmora and Lake to the Ontario Land Tribunal (OLT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Marmora and Lake before the by-law is passed, the person or public body is not entitled to appeal the decision.

 If a person or public body does not make oral or written submissions at a public meeting or make written submissions to the Township of Marmora and Lake before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
