Notice Of Passing Of A Zoning Bylaw 2022-51P
TAKE NOTICE that the Council of the Municipality of Marmora and Lake passed bylaw 2022-51P on the 6th day of September 2022 under Section 34 of the Planning Act, 1990, as amended.
PURPOSE AND EFFECT OF BYLAW 2022-51P:
The purpose and effect of the by-law is to rezone a portion of the subject lands, located on 917 Cook Road, Marmora, ON legally described as Concession 1, Pt Lot 10 on Registered Plan 21R21742 Part 3 (Crowe Lake); Municipality of Marmora and Lake, Hastings County, from the Limited Service Residential (LSR) Zone to the Limited Service Residential Exception No. 9 (LSR-9) Zone to permit the construction of an accessory building with the following exceptions: a front yard setback of 4.6 metres, to permit an accessory building in front of the principle building, to permit an accessory building to have an area of 78 square metres, and to permit the height of the accessory building at 5.3 metres.
AND TAKE NOTICE, under the Planning Act Section S.34 (19) any person or public body may, not later than September 26, 2022, appeal to the Ontario Land Tribunal in respect of the bylaw by filing with the Municipal Clerk the Appellant Form (A1) setting out the reasons for the appeal and accompanied by the prescribed fee $400.00 payable to the Minister of Finance.
Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
Any and all written and oral submissions relating to this application that were made to the Municipality of Marmora and Lake before its decision in relation to zoning by-law amendment no. 2022-51P have been, on balance, taken into consideration by the Council of the Municipality of Marmora and Lake as part of its deliberations.
