Notice of Passing of a Zoning Bylaw by the Municipality of Marmora and Lake
TAKE NOTICE that the Council of the Municipality of Marmora and Lake passed bylaw 2019-33 on the 2nd day of July under Section 34 of the Planning Act, 1990, as amended.
PURPOSE AND EFFECT OF BYLAW 2019-33:
The purpose and effect of the by-law is to rezone Part of Lots 5 and 6 on Plan 83, Pts 2 and on RP 21R-2109, and Part 1 on RP 21R-21914 from the Main Street Centre (MC) Zone to the Special Main Street Centre 4 holding (MC-4-h) Zone. The Special Main Street Centre 4 holding (MC-4-h) Zone permits an increase to the Maximum height of a building to 14.5 m, reduces the minimum landscaped area to 4.8%, reduces the minimum parking for a residential units to 1.28 spaces per unit, and commercial parking requirements to 0 spaces and reduces the minimum length of a parking spaces to 5.5 m, in order to facilitate the construction of a 4 storey building with commercial uses along the street/ground floor and 18 residential uses.
AND TAKE NOTICE, under the Planning Act Section S.34 (19) any person or public body may, not later than July 23, 2019, appeal to the Local Planning Appeal Tribunal in respect of the bylaw by filing with the Municipal Clerk the Appellant Form (A1) setting out the reasons for the appeal and accompanied by the prescribed fee $300.00 payable to the Minister of Finance.
Only individuals, corporations and public bodies may appeal a zoning bylaw to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
Any and all written and oral submissions relating to this application that were made to the Municipality of Marmora and Lake before its decision in relation to zoning by-law amendment no. 2019-33 have been, on balance, taken into consideration by the Council of the Municipality of Marmora and Lake as part of its deliberations.
